What is the rule regarding sale of common area in an apartment building?
We have this huge problem in our apartment complex in Bangalore. Couple of owners are claiming exclusive access to the set-back area. They claim this to be their own garden space, and and are planning to commercialize the area. Can the builder give the title to the space? There is no mention of the same in Sale Deed of the owner claiming such ownership. Additionally, can the original promoter (after 10 years) sell the set-back area by registering a new sale deed?
What is the 7-11 document?
1) the 7-11 records should prove who own’s the place
2) If the conveyance deed is done in the society’s name builder cannot stake his claim
3) common area cannot be sold or rented or leased to any member or non-member of the society as per by-laws.
4) pay some bribe and get the layout approved by the ward office of your municipality. The blue prints will answer your query.
5) If couple of owners claim exclusive access to the set-back area ask them to PROVE IT in the blue print submitted dated the NOC given to builder to constuct the property.
