2fine, you know I am a car salesman. Emale me direct and tell me who has a lein on that title. Tell your sister to fax me copies of the paperwork and I'll do what I can to help you. I hate dishonest car people because it makes us all look bad. We have talked thru email on other issues, trust me on this one.
References :
Bottom line, if you have a title which confers ownership to you, check to make sure that the title does not list any lienholders. If there are no lienholders, then nobody else has any claim to the vehicle.

If the previous owner believes he is still owed money, let him prove it in court with a contract and a record of payments. Any attempt at 'repossession' is nothing more than theft.

The question of legal title is easy enough. Title would need to be legitimately in your name in order to comply with the annual registration.
References :
I agree if the title is in her name he can not legally repo it however she needs to understand that you do not get into any kind of doggy situation like this with out some fall out.
paying cash in odd spots?? no receipts no good proof of purchase? This is dangerous and setting herself up to get taken, stolen from or worse she may have bought a stolen car.
If the police are called in she could lose her money and the car.
I know this was not you however when buying your first car you should always have an adult with you to make sure that everything is done right and legally.
References :
Is the title he gave her real? If she has the title in her name and the car, then she owns the car. If the other guy didn't want anything in writing then that's his own fault. A contract like that to be enforceable would have had to be in writing so that guy won't have any recourse if your friend didn't pay anymore money to him. She should make sure that it is a real title though and she should never pay him in cash without a receipt.
References :
If her car is repossessed she should call the police. The title is in her name, it would be car stealing if someone stole a car from someone who owned it. If the people want to file a civil suit they can do that but other than that, I think they are no longer associated with the vehicle and have no claim to it.
This is just what a figure, not that I have any training on the matter.
References :
Can he repossess her car?
This is by far the craziest thing that I have ever heard of in my life. This is absolutely true though. A friend of my sister was talking to her today. She says that she purchased a used car from a guy. There was something wrong with the car and he gave her another one. She says when he gave her the other one that he gave her the title to the car with just her name on it without the car sales lot or anything. She said that she called him and informed him of it and he said he knows but he cannot write up any paperwork in the county and the car is legally in her name and he intentionally put the title in her name but she has to still make payments to him. She says that he had a lot in one county, went to another county and then decided he did not want the lot there. Then she said that she would have to meet him in different locations to pay him money for the car. Places like stores or supermarkets and always in cash. She says that she believes that she has paid him all of his money......
but he says she still needs to pay him. She says that she feels like she should not pay him anymore money. Now this whole set up sounds weird to me., but my sister says that she has been there when he called. She was wondering would it be legal if he tried to take her car? If he did, what recourse would she have?
BTW, this is all in the state of NC.
